This Privacy Policy applies only to personal data that we collect on the website www.ArnottEurope.com (the “Site”) as it may be modified, relocated and/or redirected from time to time. Personal data means information that relates to you as an individually identifiable person, such as your name, e-mail address, and mobile number.

Accordingly, this Privacy Policy does not apply to information collected by anyone other than us (even if related to our business), information collected other than via the Site, and non-personally identifiable information, which, standing alone, cannot be used to determine your identity.

  1. Information You Give Us

    We collect personal data that you voluntarily share with us through the Site. For example, we collect information from you when you create an account, make a purchase or fill out a request form on the Site.

    The personal data we collect from you may include, without limitation:

    • Contact information, including name, address, email address, and telephone number.
    • Messages you send to Arnott, for example, a product inquiry that may contain information such as order numbers, requests for return merchandise authorization (RMA), vehicle identification number (VIN) and other information.
    • Personal information collected by electronic surveys that Arnott conducts (for example a contest entry or after purchase satisfaction survey). Surveys may expressly ask you for your personal details so we can provide additional information or follow up.
    • Data (some of which may be personal data) collected by automated means when you call our customer service center. For instance, we may record audio of these calls for quality control and training purposes.

    We also collect certain information which may include personal data when you submit (a) order information, including name, company name, product information, and delivery address; and (b) payment information, including billing address, credit card number, expiration date, and CVV into the Site (this information is transmitted via Transport Layer Security (TLS) encryption to a third-party order and payment processor and is not stored on Arnott servers).

  2. Information We Collect Through Technology on The Site

    We may collect and store information through various technologies when you access the Site. Some of the information we collect and store and the technologies we use to do so are discussed below.

    General Use and Preference Information

    When you visit the Site, we may collect and store information regarding your use of the Site, such as details of how and when you used the Site, your interactions on the Site (including resources and pages that you access), your location, your device identifier and type, your browser information, and your Internet Protocol (IP) address. An IP address is often associated with the portal you used to enter the Internet, like your Internet Service Provider (ISP), company, association, or university. The information described in this paragraph, standing alone, cannot be used to determine your identity. Such information may, however, be combined in a way that makes it become personal- data (i.e., information that can identify you).     Do We Use Cookies?

    Yes.     Google Analytics

    We use cookies provided by Google Analytics, a third-party service provider, to assist us in better understanding our Site visitors. These cookies collect data tied to a user’s IP address, such as the length of time a user spends on a page, the pages a user visits, and the websites a user visits before and after visiting the Site. Based on this information, Google Analytics compiles aggregate data about Site traffic and Site interactions, which we use to offer better Site experiences and tools in the future.     Web Beacons

    We include small graphic images or other web programming code, called web beacons (also known as “pixel tags”, “web bugs” or “clear GIFs”), on the Site. The web beacons are minute graphics with a unique identifier. They are used to track the online movements of Web users. In contrast to cookies, which are stored in a user’s computer hard drive, web beacons are embedded invisibly on Web pages and are about the size of the period at the end of this sentence.

    Your ‘Do Not Track’ Browser Setting

    We support the Do Not Track (DNT) browser setting. DNT is a preference you can set in your browser’s settings to let the websites you visit know that you do not want the websites collecting your data.

    We may track your online activities over time and across third-party websites or online services. For example, we might use web beacons to help us determine what links or advertisers brought you to our Site. We then track your activities on our Site. We also may use web beacons to track your visits to other websites so that third-party service providers can display Arnott advertisements to you on those other websites based on your activities while on the Site (“remarketing”).   3. Information Third Parties Provide About You

    We may supplement the information we collect about you through the Site with records received from third parties. For example, the service provider that processes orders submitted through the Site shares your order information, but not payment information, with us.

    Furthermore, our third-party email services providers, such as Constant Contact, may include – page tags (also known as web beacons) and other technologies in emails to you that allow the sender to collect information about who opened those emails, and to otherwise track your engagement with any links in the emails sent (for example, when you click a link).

    In each case, the information we receive from third parties depends on the third party and that third party’s information collection and use policies.     The Site includes links from the Site to, and plug-ins (such as Facebook and Twitter buttons) from, sites or applications operated by third parties (“Third-Party Sites”). Arnott does not control any Third-Party Sites and is not responsible for any information they may collect. The information collection practices of a Third-Party Site are governed by their privacy policies. It is your choice to enter any Third-Party Site. We recommend that you read their privacy policies if you choose to do so.

CHILDREN’S ONLINE PRIVACY PROTECTION ACT COMPLIANCE

We do not knowingly collect any information from anyone under 13 years of age and you should not provide us with any information regarding any individual under the age of 13. The Site, and our products and services are intended to be accessed and used only by adults and are not directed to minors. If you are below the age of 18, you may access or use our Site only under the supervision of a parent or legal guardian who agrees to be bound by this Privacy Policy.

Data Retention

  1. All locations outside of the United States

    The personal data collected through the Site is downloaded to a server maintained by Arnott, LLC. Arnott is located at 100 Sea Ray Drive, Merritt Island, Florida in the United States. Arnott will comply with requests to exercise individual data rights in accordance with applicable law. You can contact [email protected] to request to exercise your data rights.

  2. European Economic Area and Switzerland

    The information in this section, as well as the information in the section above titled “All locations outside of the United States”, applies to users in the European Economic Area and Switzerland (collectively, the “EEA”).

    Individuals in the EEA (“EEA Individuals”) are not required by statute or by contract to provide any personal data to the Site. Arnott sometimes uses EEA Individuals’ personal data submitted through the Site for automated decision-making. For example, Arnott may display advertisements and send emails to you containing content automatically chosen based on the products you have ordered from us in the past. However, Arnott will not use EEA Individuals’ personal data submitted through the Site for automated decision-making, including profiling, which produces legal effects or similarly significantly affects the EEA Individual.

    Cross-Border Data Transfers:
    The personal data collected through the Site will be transferred to the United States. The recipients of personal data collected through the Site (listed in Section 3 above) are located in the United States or in the country where the data was collected. In addition, Arnott processes your personal data as necessary for the performance of the sales contract, for example, when processing your orders and payments, and to take steps, at your request, before entering into a contract with you. Any withdrawal will apply only prospectively, and Arnott will continue to retain the personal data that EEA Individuals provided before they withdrew their consent for as long as allowed or required by applicable law. To protect your privacy, we will take commercially reasonable steps to verify your identity before granting access to or making any changes to your Personal Data.
